General Terms and Conditions

Article 1 – Definitions
- Seller: Viv! Christmas, located in Dreumel (The Netherlands), trading under the name Viv! Christmas.
- Customer/Consumer: The natural person not acting in the course of a profession or business who enters into an agreement with the seller.
- Agreement: A distance purchase agreement between the customer and the seller via the webshop www.vivchristmas.com
or in the physical store.
Article 2 – Applicability
- These terms apply to all orders, agreements and deliveries via Viv! Christmas, unless otherwise agreed in writing.
Article 3 – Offer & Prices
- All webshop prices include VAT and exclude shipping costs (unless stated otherwise).
- We do our best to display all information accurately. Errors or typographical mistakes are not binding.
- Offers are valid while stocks last or within the specified period.
Article 4 – Payment
- Orders placed through the webshop must be paid in full in advance using the available payment methods (including iDEAL, credit card, PayPal).
- Reservations or pre-orders require a 30% deposit, which will be clearly stated during checkout.
Article 5 – Pre-Orders
- A 30% non-refundable deposit is required for pre-orders, unless the seller cancels the order.
- The remaining 70% plus shipping costs will be charged on or around the date stated on the product page.
If an order contains multiple pre-order items with different delivery dates, the remaining balance will be collected in one payment at the first delivery date. - Orders containing both pre-order and in-stock items will be shipped together once all pre-order items have arrived. Partial shipments are possible only with an additional shipping fee.
- Indicated delivery times are estimates. Delays caused by suppliers, transport or customs are beyond the seller’s control. Cancellation by the customer is only possible if delivery has not taken place before 1 December 2025.
- If an item becomes unavailable (e.g. due to production issues or transport damage), the order will be cancelled and all payments, including the deposit, will be refunded.
Article 6 – Delivery
- We ship within Europe. Indicative delivery times are listed on the Shipping & Returns page.
- Orders are delivered by recognized carriers. The risk of shipment remains with us until the package has been delivered to you.
- Shipping costs are shown during checkout.
- XL and XXL items always incur a surcharge, even if the order exceeds the free-shipping threshold. XXL items are shipped on pallets; costs depend on the delivery address and are available on request.
- If a package is not collected in time at a pick-up point and is automatically returned to us, it will be treated as a return. Standard return fees for NL/BE/DE or the actual carrier charges for other countries will be deducted from the refund.
Article 7 – Right of Withdrawal & Returns
- You have the right to cancel your order within 14 days of receipt without giving a reason.
- For returns from the Netherlands, Belgium and Germany we charge a fixed return fee.
- For returns from other European countries, all return costs are the responsibility of the customer.
- The full purchase price, including the original shipping costs, will be refunded within 14 days of cancellation, provided the return is received in good condition.
- The customer is responsible for secure packaging (preferably the original shipping box) to prevent damage during transport. Returns remain at the customer’s risk until received by us. Always keep the proof of shipping.
- If the entire order is returned, any free ornament or gift must also be returned. If not returned, the value will be deducted from the refund.
- Exceptions:
- Products with a broken seal or signs of use
- Custom-made or specially ordered items (e.g. XL or XXL sizes)
- Products returned without the original shipping box or insufficiently protected, resulting in transport damage
- Products from the Final Sale page
- B-grade (second-choice) items
Article 8 – Changes to the Agreement
- If it becomes necessary to amend or supplement the order or delivery during execution, we will discuss this with you in advance.
- If the change affects price or quality (for example due to transport cost changes), we will inform you beforehand. If you do not agree with the new terms, you may cancel the order free of charge.
Article 9 – Warranty & Complaints
- All products are covered by statutory warranty: the product must meet reasonable consumer expectations.
- If you receive a product that is damaged or incomplete, please report transport damage or missing items within 48 hours to info@vivchristmas.com with photos and a description.
- Where possible we will arrange repair, replacement, or a refund.
- Complaints can be sent to info@vivchristmas.com. We respond within 5 days and will work with you on a solution.
- The warranty does not apply if:
- the product has been used for unintended purposes,
- damage was caused by improper use, or
- the product was modified or repaired by the customer or third parties without our consent.
Article 10 – Force Majeure
- In circumstances beyond our control (e.g. supplier delays, strikes, natural disasters) delivery may be delayed. We will notify you as soon as possible.
Article 11 – Retention of Title
- Products remain the property of Viv! Christmas until full payment has been received.
Article 12 – Liability
- We are not liable for damage caused by improper use of our products.
- Our liability is limited to the purchase amount unless caused by intent or gross negligence.
Article 13 – Governing Law
- These terms are governed by Dutch law. As a consumer you have the right to submit disputes to the competent court in your place of residence.
